The petitioner seeks bail in connection with Kalyanpur P.S. Case No. 283 of 2018 dated 07.12.2018 instituted for the offences under Sections 341, 323, 504, 506, 436 and 34 of the Indian Penal Code. The petitioner and one another is said to have set the shop of the informant on fire, leading to severe losses.

It has been submitted on behalf of the petitioner that the informant, from the deposition made in the FIR, does not appear to be an eye witness to the occurrence and because of some business transaction dispute, the aforesaid accusation has been made. The petitioner has not been seen coming back to the shop to

The petitioner is in custody since 01.02.2019. It further appears from paragraph-3 of the petition that the petitioner has been made accused in three cases but not under any serious offence and that he has been granted bail in all the three cases. Considering the aforesaid facts as also the period of custody, the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari in connection with Kalyanpur P.S. Case No. 283 of 2018.
