This application for anticipatory bail arises out of Bheja P.S. Case No. 103 of 2018, disclosing offences under Sections 147,148,149,341,323,324,307,354A,379,447, 504 506 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel appearing on behalf of the petitioner has submitted that there is allegation against co-accused Sobhi Yadav of having opened fire on the informant, which hit the informant's wife in her finger causing injury. So far as this petitioner is concerned, there is no allegation of assault against him except that he attempted to outrage the modesty of the informant's wife. He has contended that even the said allegation against the petitioner suffers from vagueness. On the
Patna High Court CR. MISC. No.26093 of 2019(2) dt.22-04-2019 2/2 perusal of the First Information Report, I find substance in the submission of the learned counsel for the petitioner. This application is allowed.
Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-II, Jhanjharpur, Madhubani in Bheja P.S. Case No. 103 of 2018 G.R. No. 1366 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
