Shailendra Kumar-2, APP for the State.

The petitioner prays for grant of anticipatory bail in Khanpur P.S. Case No. 88 of 2016 registered under Section 47(a) of the Excise (Amendment) Act, 2016.

On a tip, the Police is said to have intercepted the vehicle carrying huge quantity of IMFL. The petitioner was driving the said vehicle.

Contention of the petitioner is that he is the owner as well as driver of the vehicle. It was given on rent and in the mid way, somebody loaded these liquor on the vehicle. Considering the facts and circumstances of the case, in my view, it is not a fit case for grant of anticipatory bail to the petitioner. Prayer is rejected. Let the petitioner surrender and pray
