JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-05-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Narpatgani P.S. Case No.491 of 2017 registered under Sections 147, 341, 323, 324, 325, 307, 379 and 504 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that though the petitioners are named in the first information report, no allegation has been made against them to have participated in commission of crime or in any manner intimidated the informant and others.

Learned counsel for the State has opposed the prayer for

Patna High Court Cr.Misc. No.29577 of 2018 (2) dt.17-05-2018 2/2 grant of pre-arrest bail to the petitioners.

Considering the submissions made above and the specific allegation made in the first information report against coaccused Rahmat Ali and Md. Ghalib, the petitioners who are said to be of clean antecedent, in the event of arrest or surrender in the court below within six weeks from today, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No.491 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
