2. The matter has come up under the heading of office notes as on account of report of the Mediation Center, extension of time has been sought for the purpose of settlement.
3. However, learned counsel for the petitioner submits that despite valid service of notice in the present case, the OP.No.2 has not appeared till date either in proceeding before the court or before the Mediation Centre.
4. In such view of the matter, the case is taken up on merits.
5. Petitioner is apprehending his arrest in a case registered for the offences punishable under sections 323, 341,
Patna High Court CR. MISC. No.34570 of 2024(8) dt.12-05-2025 2/3 498A, 504, 506 of the Indian Penal Code.
6. The case is one under section 498A and the petitioner is husband. The FIR disclosed the allegations of demand of dowry and torture.
7. Learned counsel for the petitioner submits that the allegations made in the FIR are not correct and as a matter of fact, the petitioner has always been ready to keep his wife with full honour and dignity. It is rather the wife, who has not been co-operating with the husband, which would be apparent from the fact that despite repeated several notices, no one appears on her behalf.
8. Considering all the above mentioned facts and circumstances, I am inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, in the event of his arrest/ surrender within a period of four weeks from today the petitioner shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in connection with Goraul ( Kathara O.P) P.S.Case No.518 of 2023, subject to condition as laid down under section 438(2) of the Cr.PC and subject to the further condition that the petitioner shall co-operate in
