2. This is the third attempt of the petitioner for grant of regular bail in connection with Akbarpur P.S. Case No. 62 of 2022 registered for the offence under Sections 395, 397 and 307 of the Indian Penal Code.

3. Earlier the bail application of the has been rejected twice vide orders dated 22.05.2023 and 27.06.2025 passed in Cr. Misc. No. 67276/2022 and Cr. Misc. No. 48691/2024 respectively.

4. The petitioner is in custody since 10.05.2022 and has ten criminal antecedents.

5. Learned counsel for the petitioner submits that charges have not even been framed because other co-accused who are on bail are not appearing in the trial.

6. Considering the gravity of offence and the criminal antecedent of the petitioner, no fresh ground for review is made out, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed with direction to the court below to frame the charges of the petitioner after separating the case of the petitioner from the other co-accused persons.
