1. Heard learned counsel for the petitioner and learned APP for the State.

2. On query of the court, with regard to the stage of the case, the learned counsel for the petitioner very fairly submitted that despite his best endeavours he could not contact the petitioner or the deponent who has sworn the affidavit nor the petitioner or anyone on his behalf ever contacted him in these six years, as such, he is not in a position to inform the Court about the present status of the case.

3. Learned APP for the State, Mr. Chandra Bhushan Prasad submits that in the present quashing application the order dated 30.08.2017 is under challenge by which an application filed on behalf of the petitioner under Section 311 of the Cr.P.C was rejected. It is next submitted that much water has flown,

Patna High Court CR. MISC. No.55711 of 2017(2) dt.06-12-2023 2/2 thereafter, and the chances are bright that the trial might have even concluded by now, as such, the Court should not interfere.

4. Considering the submission made by the learned APP for the State, the Court is not inclined to entertain the present quashing application.

5. Accordingly, the quashing application stands rejected.
