Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner apprehends his arrest in Muffasil (Chapra) P.S. Case No. 403 of 2019, registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and sections 25(1-b)a, 26 and 35 of the Arms Act. Petitioner has been named in this case on the basis of confessional statement of co-accused who were apprehended on the spot with arms and ammunitions.
It is submitted that petitioner has been falsely
Patna High Court CR. MISC. No.24548 of 2020(2) dt.06-10-2020 2/2 implicated in this case. Save and except confessional statement of co-accused, there is no material against this petitioner. No incriminating article has been recovered from possession of this petitioner. Petitioner claims clean antecedent as mentioned in para 3 of the bail petition.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Chapra at Saran in connection with Muffasil (Chapra) P.S. Case No. 403 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
