JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-10-2020 Heard learned counsel for the petitioners and learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in Akbarpur P.S. Case No. 164 of 2020 registered for the offence under Sections 147, 148, 149, 295, 295(A), 153, 153(b), 341, 323 of the IPC. As per the prosecution case, the informant, who is officer incharge of Akbarpur Police Station, received information that two communities were engaged in brick-batting and as such, he alongwith police party reached at the place of occurrence and arrested four persons, who disclosed the name of petitioners.
Patna High Court CR. MISC. No.24524 of 2020(2) dt.01-10-2020 2/2 It is submitted on behalf of petitioners that petitioners are innocent and have been falsely implicated in this case. It is further submitted that save & except confessional statement of co-accused, there is nothing against these petitioners. There is no specific allegation against these petitioners. It is stated in paragraph - 3 of the petition that petitioners have no criminal antecedent.
Considering the aforesaid facts and circumstances, the anticipatory bail application of petitioners is allowed. In the event of arrest or surrender within a period of eight weeks from the date receipt/production of copy of this order, let the abovenamed petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S. Case No. 164 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
