The petitioner seeks pre-arrest bail in connection with C.A. Case No.86(C) of 2017 registered for the offences under Sections 200 and 202 of I.P.C.
Accusation is that the informant was accompanied by her maternal uncle Akhlak Ahmad where she was kept at the house of this petitioner about four months. Thereafter the petitioner started to treat her with bad eye and talked her in filthy language due to which she returned to her house. Again in the month of December, 2015 the petitioner returned to the village of the informant and
Patna High Court Cr.Misc. No.31409 of 2018 (2) dt.12-06-2018 2/2 developed physical relation with her and after giving assurance of performing marriage with her the petitioner went away to Bombay and he did not return back.
Learned counsel appearing on behalf of the petitioners submits that, in fact, the complainant is the divorcee lady and only to extract the money the present complain petition has been filed with false allegation without giving any information about the incident as averred in the complaint petition before any authority. Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within six weeks from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Masaurhi in C.A. Case No.86(C) of 2017 subject to the condition as laid down under Section 438(2) Cr.P.C.
