Petitioner apprehends his arrest in connection with Nokha P.S. Case No.68 of 2021 dated 08.04.2021, registered for the offence punishable u/s 409, 420, 304 and 120B of the IPC, pending in the Court of learned C.J.M., Rohtas at Sasaram. Earlier, the bail application of this petitioner was rejected by this Court vide order dated 06.04.2023 passed in Cr. Misc. No.2570 of 2023. This is the second attempt of the petitioner for grant of anticipatory bail.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. Permission is granted.

Accordingly, the instant application is dismissed as

Patna High Court CR. MISC. No.31533 of 2023(3) dt.28-06-2023 2/2 withdrawn.

However, petitioner is at liberty to surrender before the learned Court below within six weeks from today and seek regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application.
