JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Jamui P.S. Case No. 83 of 2017, registered under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Jamui. The allegation of informant, Md. Makbul, is that five persons named in the F.I.R. including the petitioners were grazing his wheat crops then he made protest, on which, Chhabila Yadav caused injury at his head through Khanti whereas petitioners also caused injury to him through lathi.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not

Patna High Court Cr.Misc. No.52199 of 2017 (2) dt.07-11-2017 inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
