The petitioner apprehends his arrest in connection with Desari P.S. Case No.369 of 2021 registered under Sections 341, 323, 354, 509, 504, 506 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that similarly situated co-accused Manjeet Kumar @ Sanjeev Kumar has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 03.01.2023 passed in Cr.Misc.No.50367 of 2022. No.29245 of 2023(2) dt.14-07-2023 2/2 the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. IX, Vaishali at Hajipur in connection with Desari P.S. Case No.369 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. with further condition:-
1. The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the prosecution will be at liberty to move for cancellation of his bail bond.
