JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-10-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 308, 379, 504 and 34 of the Indian Penal Code.

Prosecution case is that the informant on 06.05.2015 went to see his maize crop and found that some maize has been plucked and kept in a bag on the ridge of the land. The informant found co-accused sanjay Ram, Pankaj Das, Bijendra Das and son of Ramchandra Sah were present there. When the informant asked them they made assault with lathi and iron rod. The accused persons took away Rs.20,000/- from the wife of the informant. The son of Rajendra Das snatched torch of the informant. It is submitted by learned counsel for the petitioner that in the FIR four persons are named Sanjay Ram, Pankaj Ram,

Patna High Court Cr.Misc. No.46133 of 2016 (2) dt.22-10-2016 2/2 Bijendra Das and son of Ramchandra Sah, but during investigation the name of petitioner has come as son of Rajendra Ram. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the fact that the accusation has not been levelled against the petitioner and the impugned order suggests that the injury has been found to be simple in nature, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-II, Madhepura, in connection with Srinagar P.S. Case No.22/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
