====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 29-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Jurawanpur P.S. Case No. 29 of 2019, instituted for the offence under Section(s) 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

It is alleged in the written report that 120 litres of country made liquor kept in three bags has been recovered from the field of Ashok Rai.

Counsel for the petitioner submits that from the seizure list it appears that seizure has been made from the Bamboo orchard of Ashok Rai. He further submits that there is no recovery from conscious possession of the petitioner. Petitioner has been arrested in the instant case merely on

Patna High Court CR. MISC. No.27758 of 2019(2) dt.29-04-2019 2/2 suspicion. He has clean antecedent.

Petitioner is in custody since 21.3.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Excise, Vaishali, Hajipur, in connection with Jurawanpur P.S. Case No. 29 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
