2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 353, 37, 307, 342 and other allied sections of the Indian Penal Code.
3. There is allegation of raising slogans to cancel the penal list and computer test examination and damaged the Government vehicles.
4. Allegation os assault is general and omnibus against the petitioner and no specific overt act has been alleged against hi. Petitioner's name has figured during course of investigation in confessional statement of co-accused. Similarly situated co-accused persons have already granted bail by this
Patna High Court CR. MISC. No.34724 of 2023(2) dt.27-07-2023 2/2 Court vide order dated \21.07.2023 in Cr. Misc. No. 35587 of 2023. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 900 of 2018, P.S. case no of subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
