2/4 24-06-2022 Petitioner has prayed for the following relief(s):- (A) For a direction upon the National Council for Teacher Education (N.C.T.E) to restore/grant recognition to the Government Teachers training College, Saran, Chapra situated in Zila School Campus, Chapra for imparting two years B.Ed. Course for the benefit of the local students as the fee for such course is quite low, in, comparison to the same B.Ed course conducted by the private institutions. The local students of the Chapra district are suffering and are being exploited by the private institutions imparting teacher training courses for the NCTE has withdrawn/not granting recognition for imparting two years B.Ed.
course to the aforesaid Government Teachers Training College, Saran, Chapra in an arbitrary manner despite the said government institution is fulfilling all the criteria for such recognition.
(B) For quashing the order dated 03.03.2019 passed by the Regional Director, Eastern Regional Committee, NCTE whereby the recognition granted to the aforesaid government institution for imparting B.Ed. course has been withdrawn from the academic session 2019-20, without appreciating this fact that the said government institution fulfills all the criteria for such recognition.
The petition reiterates here that the order of withdrawal of
3/4 recognition has either forced the local students to leave the district of Chapra for getting such education or gave undue advantage to the private institutions to exploit the local students, desirous of having teacher training degree.
(C) For quashing the order dated 05.07.2019 passed by the Appellate Committee of the NCTE, preferred against the aforesaid order dated 03.03.2019, whereby and where under the learned Appellate Committee has confirmed the order dated 03.03.2019, notwithstanding the fact that all the evidences showing fulfillment of the criteria of imparting teacher training courses before it.
(D) For quashing the letter dated 04.08.2021 issued under the Signature of the Section Officer (Appeal) whereby it has been informed to the principal of the government institution in question that the second appeal preferred by the college has not been accepted by the learned appellate Authority for the reason that the relevant rule does not prescribe the provision of second appeal.
The Government institution in question, in desperation has preferred the second appeal, as the request for grant of recognition was not paid heed by the NCTE."
After the matter was heard for some time, finding the
4/4 Bench not to be in favour of the submission made by the learned counsel for the petitioner, learned counsel for the petitioner, under instructions, states that, in view of the intervening developments, the petition may be permitted to be withdrawn. Prayer allowed.
Petition is disposed of as withdrawn.
Interlocutory application(s), if any, shall also stand disposed of.
