2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148 , 149, 427, 385 , 504, 506 and 307 of the Indian Penal Code and Section 27 of Arms Act.

3 . As per the prosecution case , on the alleged date and time of occurrence , all the accused persons including this petitioner came at the house of the informant and made indiscriminate firing . It is further alleged that they also damaged the vehicle of the informant and threatened him with dire consequences on account of not giving Rs. 2 lakhs.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. The name of petitioner

Patna High Court CR. MISC. No.27338 of 2025(2) dt.15-07-2025 2/2 transpired during course of investigation in the confessional statement of co-accused persons Vivek Kumar. Though there is allegation of making indiscriminate firing but no one sustained any gunshot injury . There is no evidence on record against the petitioner to show his complicity in the occurrence . Similarly situated co-accused persons have already granted bail by this Court vide order dated 20.06.2024 in Cr. Misc. No. 34463 of 2024 .

5 . Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II Danapur in connection with Bihta P.S. case No. 172 of 2024 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
