28-10-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Chandi P.S. Case No. 460 of 2020, registered for the offence under Section 392, 395 of the Indian Penal Code.

As per the prosecution case, on 29.09.2020 at about 20.00 hrs., when the informant was returning home on motorcycle and reached near a bridge, three unknown miscreants riding on a motorcycle overtook him and snatched his motorcycle as also his mobile phone and thereafter, fled away.

Petitioner is not named in the FIR. Name of the petitioner has transpired on the basis of confessional statement of co-accused. It is further submitted that no looted article has been recovered from the possession of the petitioner and till date, petitioner has not been put on T.I.Parade. Petitioner is in custody since 24.01.2020.

Patna High Court CR. MISC. No.42755 of 2021(2) dt.28-10-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Chandi P.S. Case No. 460 of 2020.
