JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-01-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Kartahan P.S. Case No. 44 of 2017, registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.

Sima Devi the sister of the informant was married to Dhiru Paswan three years ago and allegedly due to non-fulfillment of demand of one motorcycle and cash of rupees one lakh she was burnt to death and the dead body was also got disappeared. Out of the wedlock there is a son aged about 8 months. Submission is of false implication and that the petitioner is uncle-in-law having no concern with the family

Patna High Court Cr.Misc. No.54921 of 2017 (2) dt.12-01-2018 2/2 affairs of the deceased and her husband. The petitioner is living separately since long. The informant after realizing the truth has filed petition in the Court below stating innocene of the petitioner and others vide P-2 and, as such, the petitioner deserves sympathetic consideration.

The learned A.P.P. fairly submits that now the informant is retracting from his earlier version. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Vth, Vaishali at Hajipur, in connection with Kartahan P.S. Case No. 44 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
