Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in Pipara P.S. Case No. 413 of 2019, registered for the offences punishable under Sections 399, 402, 413, 414, 120(b) of the Indian Penal Code and sections 25(1-b)a, 26 and 35 of the Arms Act. Prosecution case in brief is that on secret information, raid was conducted, six persons were apprehended by the police. From possession of these accused persons arms and ammunitions and looted articles were recovered. The apprehended persons disclosed the name of this petitioner.

Name of this petitioner has come in this case on the basis of confessional statement of apprehended accused persons. Nothing has been recovered from possession of this petitioner. Arms and ammunitions were recovered from possession of accused persons who were apprehended on the spot. Petitioner has got clean antecedent as stated in para 3 of the bail petition.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Pipara P.S. Case No. 413 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
