13-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Runnisaidpur P.S. Case No. 73 of 2021, registered for the offence under Section 363, 366A of the Indian Penal Code.

It is submitted on behalf of petitioner that the victim, in her statement recorded under Section 164 Cr.P.C., has stated that she out of her own will married with this petitioner and her age has been assessed between 18-19 years by the doctor and on the basis of her statement, she (victim) has been released in favour of petitioner's mother namely Chanda Devi by the order of learned Chief Judicial Magistrate, Sitamarhi dated 05.03.2021 (Annexure - 2). Petitioner is in custody since 30.01.2021.

Learned A.P.P. for the State has opposed the bail petition.

Patna High Court CR. MISC. No.38193 of 2021(2) dt.13-12-2021 2/2 Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VI Sitamarhi in connection with Trial No. 77 of 2021, arising out of Runnisaidpur P.S. Case No. 73 of 2021.
