JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-10-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Mokama P.S. Case No. 62 of 2018 registered for the offence under Section 395 of the Indian Penal Code.

As per the prosecution case, on 18-03-2019, while the informant was returning home, in the way near Mokama chowk, five miscreants snatched Rs. 4,000/- (four thousand), mobile phone alongwith motorcycle of the informant and fled away after giving threatening.

It is submitted on behalf of petitioner that F.I.R. has been instituted against unknown and name of the petitioner has come on the basis of confessional statement of co-accused Bittu Yadav. It is further submitted that the motorcycle, which is said

Patna High Court CR. MISC. No.24655 of 2020(2) dt.09-10-2020 2/2 to have been used in the aforesaid crime, has been released in favour of one Niraj Kumar. No incriminating article has been recovered from the possession of petitioner. It is stated in paragraph -3 of the petition that petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances, the bail application of petitioner is allowed. In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate - IV, Barh, Patna, in connection with Mokamah P.S. Case No. 62 of 2018, subject to condition as laid down under Section 438(2) of the Cr.P.C.
