Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in Yogapatti P.S. Case No. 290 of 2019, registered for the offences punishable under Sections 147, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.

Informant is Mukhiya of Basopatti. Prosecution case in brief is that on 05.08.2019 at about 5.30 pm, on the eve of Nagpanchami and in procession of Mahaviri Akhara at Basopatti High School campus the informant received

Patna High Court CR. MISC. No.29325 of 2020(2) dt.09-12-2020 2/2 information that two groups are engaged in fighting to each other at Basopatti village near High School. On information, he went there where FIR named accused persons including this petitioner tried to kill him and attacked on him with the butt of pistol. Petitioner is alleged to have snatched the golden chain and cash of Rs. 20,000/- from pocket of the informant. It is submitted that petitioners have been falsely implicated in this case with mala fide intention. There is case and counter case. There is no specific allegation against these petitioners.

Considering the facts aforesaid and nature of allegation, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Yogapatti P.S. Case No. 290 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
