JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-05-2019 This is an application for grant of anticipatory bail in connection with Dumariyaghat P.S. Case No. 194 of 2018, disclosing offences under Sections 448, 341, 323, 324, 325, 307, 354B, 379, 504, 506/34 of the Indian Penal Code. Allegation as per F.I.R. is that the petitioner and other accused persons assaulted the informant and her family members and specific allegation against this petitioner is of assault to the informant by Garasi causing injury on head and arm.

Submission of learned counsel for the petitioner is that there is land dispute between the parties with respect to construction of toilet and all injuries are simple in nature except one injury i.e. not attributed against this petitioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Dumariyaghat P.S. Case No. 194 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
