Petitioner apprehends arrest in connection with Bhangaha P.S. Case No. 5 of 2019 registered for the offence punishable under section 7 of the Essential Commodities Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Perusal of the first information report shows that there is no any complain of shortage of food-grains on kerosene oil. There is no any complain from any consumer with regard to irregularity or black-marketing against this petitioner. Petitioner is a man of clean antecedent.

No.28042 of 2019(2) dt.29-04-2019 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Bettiah, West Champaran in connection with Bhangaha P.S. Case No. 5 of 2019 subject to the conditions laid down under section 438(2) Cr.P.C.
