The petitioner seeks bail in a case registered under Sections 363, 366A/34 of the Indian Penal Code. Allegation is that the petitioner enticed away the daughter of the informant with an intention to marry. It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.09.2018 and has got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Out of love affair, the victim had eloped with the petitioner. Said relationship was not accepted by the parents of the victim. Subsequently she went into the custody of her parents. She made statement under Section 164 of Cr.P.C.,

Patna High Court CR. MISC. No.27131 of 2019(2) dt.26-04-2019 2/2 which was tutored by her parents.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi P.S. case No.272 of 2018.
