2. The petitioner seeks bail, who is in custody since 16.01.2026 in connection with Dhamdaha P.S. Case No. 362 of 2025, F.I.R. dated 13.12.2025 registered for the offence punishable under Sections 64,126(2),115(2),303(2) of BNS and Sections 4, 8 of the POCSO Act.

3. Allegation against the petitioner is that he committed rape upon the victim, aged about 17 years.

4. Learned counsel appearing for the petitioner submits that the allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR.

Learned A.P.P. for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that as per allegation in the FIR, the petitioner has committed rape upon the victim, aged about 17 years and apart from that, the statement of the victim was recorded under Section 183 of BNSS, 2023 in which she has categorically stated that the petitioner has committed rape upon her and she has also fully supported the case of the prosecution as well as medical report of the victim also supports the allegation as alleged in the FIR.

Considering the nature of allegation against the petitioner in the FIR, the statement of the victim was recorded under Section 183 of BNSS, 2023 in which she has categorically stated that the petitioner has committed rape upon her supported by the medical evidence, I am not inclined to enlarge the petitioner on bail in connection with Dhamdaha P.S. Case No. 362 of 2025 pending in the court of learned Additional Sessions Court-VII-cum-Spl. Court (POCSO), Purnea.

7. Prayer is refused.
