The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 337, 338, 332, 333, 186, 353, 201, 382, 511 of the IPC and 45 of the Bihar Prohibition and Excise Amendment Act, 2022 in connection with Makhdumpur Tehta O.P. Case No.736 of 2023.

3. The learned counsel for the petitioner submits that the petitioner has antecedent of two cases and the informant alleges that he along with his team reached the place of occurrence and saw two boys and two girls were drinking

Patna High Court CR. MISC. No.39595 of 2024(2) dt.01-07-2024 2/3 alcohol, when he started making video of the same thereafter, the accused persons started pelting stones and deleted the video from his mobile.

4. The learned counsel submits that it absolutely does not stand to reason that the accused persons on seeing the force would have snatched the mobile from the informant and deleted the video. It is next submitted that these are ways of implicating innocent.

5. The learned APP for the State opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise, Ist, Jehanabad in connection with Makhdumpur Tehta O.P. Case No.736 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. It is further made clear that the learned trial court shall also verify the criminal antecedent of the petitioner and in
