The only reason why the Court is willing to dismiss the writ application because in terms of the Circular dated 22.07.2003 there was obligation upon the claimant to approach the authorities, file an application, produce all the records in support of such claim of having worked and the period of work, which could be taken into consideration while working out the retirement benefit.
Petitioner is a retiree of the year 1999. The Circular contained in Annexure-C was issued on 22.07.2003. There is nothing on record to show that any effort was made by the petitioner in terms of the Circular dated 22.07.2003 till the bogey
Patna High Court CWJC No.9522 of 2015 (3) dt.13-07-2017 2/2 of a claim was raised in a writ application which came to be filed on 03.07.2015.
This Court is, therefore, not willing to reach out to a litigant who has not been vigilant to his right and keeping in view the long period which has gone past since the superannuation and issuance of Circular dated 22.07.2003.
Writ application is fit to be dismissed and is accordingly dismissed.
