JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner and the State. The petitioner had earlier filed anticipatory bail application, bearing Cr. Misc. No. 50058 of 2015, before this Court in a case under Section 395, 397 and 328 of the Indian Penal Code in connection with Atri P.S. Case No. 76 of 2014. The petitioner was granted anticipatory bail by this Court vide order, dated 18.12.2015, passed in Cr. Misc. No. 50058 of 2015.

The petitioner submits that he was suffering from serious ailment, on account of which he could not surrender within time. In support of his submission, the petitioner has annexed the medical certificate issued by Dr. Chitranjan Sharma, A. N. Magadh Medical College (P.S.M.) Gaya.

Having regard to the submissions made by the

Patna High Court Cr.Misc. No.42196 of 2016 (2) dt.15-03-2017 2/2 petitioner as well as the certificate granted by the doctor, the time period for surrender is extended by further four weeks from today before the court below (Judicial Magistrate, 1st Class, Gaya) by way of last chance, on the same terms and condition.
