JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 22-12-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Ben P.S.Case No.83 of 2017 registered under Section 366A/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the victim Priti Kumari has already been recovered and in her statement made under Section 164 of the Code of Criminal Procedure she had made direct and specific allegation against accused Manish Kumar and his cousin brother Rajesh as they were the persons who forcibly adducted her and took her to different places. The name of the petitioner has been given by the victim

Patna High Court Cr.Misc. No.61189 of 2017 (2) dt.22-12-2017 2/2 only because he happens to be father of the named accused Manish Kumar. There is no other material to connect the petitioner with the alleged offence.

Learned counsel for the State opposed the prayer for grant of pre-arrest bail to the petitioner.

Regard being had to the submissions made above, specially taken into consideration the statement of the victim recorded under Section 164 of the Code of Criminal Procedure, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif in connection with Ben P.S.Case No.83 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
