Petitioner apprehends his arrest in connection with Narpatganj P.S. Case No. 136 of 2019 / GR No. 781 of 2019 registered for the offence under Section 365 / 34 and added Section 302, 201 and 120 (B) of the I.P.C.

The allegation as per the First Information Report is that the petitioner along with other accused persons abducted the grand daughter of the informant and subsequently her dead body was found near a river.

Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged, no overt act has been attributed against him and the allegation is general and omnibus in nature. Learned counsel further submits that petitioner is the co-villager of the deceased and there is no material to connect him with the present offence.

No.28929 of 2020(4) dt.08-02-2021 2/2 On the other hand, learned counsel for the State referring to the case diary submits that during the course of investigation the witnesses have supported the allegation against the petitioner as such he does not deserve the privilege of anticipatory bail.

Having regard to the submissions made by learned counsel for the parties and taking into consideration the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, the same is rejected.
