JUSTICE SUDHIR SINGH ORAL ORDER 13-12-2016 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. The petitioners are apprehending their arrest in a case registered under Sections 302, 201 and 120B/34 of the Indian Penal Code.
Allegation against the petitioners is that they killed the husband of the informant by pressing his neck and thrown the dead body.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The
Patna High Court Cr.Misc. No.40326 of 2016 (3) dt.13-12-2016 2/2 petitioners have been named in the F.I.R. merely on suspicion. After investigation the police has submitted final form, which is Annexure-3 to the present application.
On behalf of the State and learned counsel for the informant, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Siwan in connection with Raghunathpur P.S. case No.193 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
