ANJANA MISHRA ORAL ORDER 15-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Pirbahore P.S. Case No.90 of 2016 registered for the offence punishable under Section 386, 387/34 and 120B of the Indian Penal Code.

Mr. Yogesh Chandra Verma, learned Senior Counsel appearing on behalf of the petitioner submits that though the petitioner is not named in the F.I.R., subsequently his name has surfaced on the basis of the confessional statement made before the police by one Ajit Kumar Singh. It is further submitted that since the petitioner is the brother of accused Ritalal Yadav, the name of the petitioner has

Considering the facts and circumstances of the case and in view of the fact that the name of the petitioner has come in the confessional statement made before the police by co-accused which has no evidentiary value, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna, in connection with Pirbahore P.S. Case No.90 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
