JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Terhagachh P.S. Case No. 25 of 2020 registered for the offence punishable under Sections 341, 379, 506, 384 and 34 of the Indian Penal Code.

It is alleged in the F.I.R. that two miscreants waylaid the informant, who was accompanying his relative in a motorcycle whereafter certain valuables including a mobile phone was snatched from the informant. The occurrence was of 8.30 PM in the night. Allegedly, the informant's relative could identify the petitioner by his voice. The F.I.R. was registered nearly nine days after the date of occurrence. The petitioner was

Patna High Court CR. MISC. No.33138 of 2020(6) dt.13-01-2021 2/2 subsequently apprehended and allegedly he made a confessional statement before the police. The petitioner is in custody since 05.05.2020.

Learned counsel appearing on behalf of the petitioner has submitted that after the petitioner's implication in the present case, he has been remanded in other cases also. Considering the nature of accusation and petitioner's custody since 05.05.2020, this application is allowed.

It is noted that the police have already submitted the charge-sheet on completion of investigation in this case. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in Terhagachh P.S. Case No. 25 of 2020.
