14-12-2016 Heard Sri Rudal Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Sohsarai P.S. Case No. 116 of 2016 registered for offence under Section 47 of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated on the basis of disclosure made by one of the co-accused, who was apprehended from a Honda City vehicle. From the said vehicle, about 9 litres of Indian-make foreign liquor was recovered. Learned counsel for the petitioner has drawn my attention to the statement made in paragraph - 3 of the petition to show that petitioner is having

Keeping in view the fact that petitioner's name has come as per confession made by co-accused as well as the fact that petitioner is having clean antecedent, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Subodh Kumar @ Bulet be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Sohsarai P.S.Case No. 116 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
