2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 302, 120(b) of the Indian Penal Code and Section 27 of the Arms Act.

3. It is alleged that the son of the informant was called by the co-accused Ranjeet Chaudhary, who took him away to Maithil chowk and the informant also followed them from behind. In the meantime, all the FIR named accused persons including the petitioner, surrounded the son of the informant and on the insistence of co-accused Usha Devi, co-accused Vishal Yadav, fired pistol upon the son of the informant who died on the way to Siliguri for treatment. Petitioner is amongst the accused persons who had surrounded the victim.

4. It is submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.29226 of 2023(2) dt.17-07-2023 2/2 specific allegation of firing upon the deceased is against coaccused Vishal Yadav. Several co-accused, with similar allegation, have already been allowed pre-arrest bail by this Court vide orders passed in Cr. Misc. No. 44927 of 2023 and 19124/2023.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Town (Sahayak) P.S. case no. 283 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
