JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 06.12.2016 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with a case registered under section 307 and other minor sections of the Indian Penal Code.

There is allegation of assault against petitioner nos.1, 2 and 3 and so far as petitioner nos.4 and 5 are concerned, no allegation of assault has been levelled against them. Considering the aforesaid facts and circumstances as well as submissions of the parties, prayer of anticipatory bail of petitioner no.1, 2 and 3 stands rejected.

So far as petitioner nos.4 and 5 are concerned, it is

Patna High Court Cr.Misc. No.44578 of 2016 (3) dt.06-12-2016 ordered that, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioner nos. 4 and 5, namely, Jaibun Nesha @ Jaibun Nessa and Saidun Khatoon be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate IV, East Champaran at Motihari in Sangrampur P.S. Case no. 39/2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
