JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-01-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Bairiya P.S. Case No. 132 of 2018 for offences under Sections 341, 323, 324, 354(B), 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedents. Learned counsel further submits that the petitioners have been falsely implicated in this case. The dispute has arisen on account of grazing the maize crop by the she-goat and just to exaggerate the allegation, the present case has been lodged with concocted story.

No.28468 of 2020(2) dt.19-01-2021 2/2 Considering the aforesaid, the Court is inclined to grant the privilege of anticipatory bail to the petitioners subject to the condition that the petitioners have to deposit Rs.25,000/- in cash. On depositing the amount of Rs.25,000/-, petitioners, above-named, in the event of arrest or surrender within one month from today, shall be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Bettiah, West Champaran in connection with Bairiya P.S. Case No.132 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Deposit of Rs.25,000/- (Rupees twenty five thousand) shall abide by final outcome of Bairiya P.S. Case No.132 of 2018.
