JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-09-2020 Heard learned counsel for the petitioner as well as learned APP for the State through video conferencing. Petitioner is an accused in a case registered for offence punishable under Section 341, 342, 233, 354 (B) 386, 504, 506, 120(B)/34 of the Indian Penal Code. Prosecution case is that, co-accused Bikram Bedi caught hold of the informant, drove her to the road side and abused her. He also slapped her and threatened her with dire consequences if she does not withdraw the case. It is submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to dirty village politics. It is further submitted that co-accused Bikram Bedi is the main person against whom the allegation has been made. The petitioner's name has surfaced during the course of

No.24216 of 2020(2) dt.22-09-2020 2/2 investigation on confessional statement of co-accused Bikram Bedi, who has been allowed regular bail by this Court vide order dated 16.01.2020 passed in Cr. Misc No. 87350 of 2019. Other similarly situated accused persons have also been allowed bail vide annexure- 3. Charge sheet has been submitted in this case. Petitioner is in custody since 04.10.2019.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Munger in Jamalpur Police Station Case No.171of 2019, on the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, their bail-bonds shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence of witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
