Petitioners are in custody in connection with Chainpur P.S.Case No.184 of 2020 for the offence under Sections 302 and 120(B) of the Indian Penal Code. Learned counsel for the petitioners would submit that the petitioner no.1 has clean antecedent; whereas petitioner no.2 has one criminal antecedent, i.e, of the year 2008. Referring to the prosecution case, Mr. Vipin Kumar Singh, learned counsel for the petitioners would submit that except the suspicion there is no material to connect the petitioners with the commission of the crime. No one has seen the occurrence. The

No.24795 of 2020(3) dt.09-11-2020 2/2 reason of suspect to these petitioners in the death of the victim is that some time back petitioner no.1 has threatened the deceased for playing Music on his mobile phone while he was passing through. The brother of the informant was found dead at the tubewell of one Gurucharan Yadav in the dead night and no one has seen the occurrence.
Under such circumstances except the suspicion there is no material to suggest involvement of the petitioners in the commission of crime, the Court is inclined to grant bail to the petitioners named above on furnishing bail bond of Rs.25,000/- (twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-II, Bhabua in connection with Chainpur P.S.Case No.184 of 2020.
