The petitioner has preferred this writ application under Articles 226 and 227 of the Constitution of India for a direction to the learned court below to dispose of Complaint Case No. 2082 of 2005 (Vijay Laxmi Vrs. Satya Narayan Mahto and another) in pursuance of direction of this Court in Cr. Misc. No. 39707 of 2009 vide Annexure-3.

Submission of the learned counsel for the petitioner is that after the order of this Court dated 17.08.2012, in Cr. Misc. No. 39707 of 2009, the petitioner had filed a petition before the learned court below on 19.02.2013 for notice to the complainant for settlement of dispute on the basis of compromise arrived at between the parties at the Mediation Centre of the Patna High Court. On the

Patna High Court Cr. WJC No.540 of 2016 dt.02-08-2017 2/2 petition itself, the learned Presiding Officer recorded that stay is there whereas no stay has been ordered from any Court in the said matter. In the circumstances, the learned Judicial Magistrate, 1st Class, Hajipur (where the case is pending) is directed to dispose of the said complaint case according to law within three months. With the aforesaid observation, this writ application stands dispose of.
