JUSTICE ARUN KUMAR ORAL ORDER 23-05-2018 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in Maranchi P.S. Case No. 22 of 2018 instituted for the offences punishable under Sections- 147, 148, 149, 341, 323, 353, 385, 386, 393 and 504 of the Indian Penal Code.

Allegation against the petitioners is that they got forcibly release co-accused Rajesh Kumar who was in drunken condition. Learned counsel for the petitioners submits that the allegation itself is absurd and it is impossible to get release any person from the custody of armed police personnel, without causing injury to any police personnel and all petitioners are family members of coaccused Rajesh Kumar, have been made accused and all have clean antecedent.

Patna High Court Cr.Misc. No.32135 of 2018 (2) dt.23-05-2018 Having considered the said facts and circumstances, the petitioners, named above, are directed to be released on anticipatory bail in the event of their arrest or surrender in the court below within four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Maranchi P.S. Case No. 22 of 2018 to the satisfaction of learned A.C.J.M-cum-Sub Judge- IV, Barh (Patna) subject to condition as laid down u/S 438(2) of the Cr.P.C..
