The petitioner apprehends his arrest in a case registered for the offence under Sections 420, 120(B), 467, 468, 471, 342, 504, 506, 406, 149/34 of the Indian Penal Code. As per the prosecution case, all the F.I.R. named accused persons including this petitioner fraudulently executed the sale-deed in favour of this petitioner.
It is submitted on behalf of petitioner that petitioner is a bona-fide purchaser of the land in question and has purchased the same from the informant through registered sale deed on payment of consideration money. The said land has been mutated in his name and he has been paying rent to the government of Bihar, but only with a view to extort money, the informant has filed the instant case. Petitioner has not cheated or committed any fraud.
Patna High Court CR. MISC. No.29052 of 2022(2) dt.26-09-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saran at Chapra in connection with Mashrakh P.S. Case No. 449 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
