This application has been filed seeking cancellation of bail allowed to Opposite party by order, dated 13.07.2012 passed in Criminal Misc. No. 23396 of 2012. There are two grounds taken for cancellation of the petitioner's bail. It has been asserted that he has been made accused subsequently also in cases of similar nature. There is nothing substantial to show that the Opposite party has attempted to threaten the witnesses. It is also not clear that the Opposite party has absented himself from the Court or refused to join the police in course of investigation. Even the stage of trial is not known. In such circumstance, I do not find to be a fit case for cancellation of bail exercising power under Section 439(2) of the Code of Criminal Procedure, 1973.

This application has no merit and it is, accordingly, dismissed.
