JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-12-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends her arrest in connection with Hilsa P.S. Case No. 391 of 2016 for the offence punishable under section 47 (A) of the Excise Act.

Allegedly, the house of the petitioner was raided and from there apparatus of preparing illicit Mahua liquor, articles such as solution of Mahua Jeggery and one liter prepared liquor were recovered and for that the petitioner and her husband both have been made accused.

Submission is that the petitioner has got no concern,

Patna High Court Cr.Misc. No.47557 of 2016 (2) dt.15-12-2016 2/2 she is merely the house wife, the husband has already been allowed regular bail and the petitioner is apprehending her arrest in this case having no criminal antecedent.

The learned A.P.P. fairly submits that for the same offence the petitioner and her husband both have been made accused.

In the facts and circumstances as stated above, considering recovery of small quantity, the petitioner, in case of her arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M. Hilsa, Nalanda in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
