The petitioners seek pre-arrest bail in connection with Kahalgaon P.S.Case No. 22 of 2012 registered under Section 302/34 of the Indian Penal Code.

Regard being had to the fact that though the petitioners are named in the First Information Report, on completion of investigation, the police found them innocent and they were not sent up for trial, but the learned Magistrate, differing with the police report, took cognizance of the offence and summoned the petitioners also, in the event of arrest or surrender before the court below within four weeks from today, they are directed to be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.61101 of 2017 (2) dt.22-12-2017 2/2 Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIII, Bhagalpur in connection with Kahalgaon P.S.Case No. 22 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
