JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-05-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Katihar Town P.S. Case No. 55 of 2018 registered under Sections 379, 406, 409 and 120B read with 34 of the Indian Penal Code and section 7 of the Essential Commodities Act. It is submitted by the learned counsel for the petitioner that similarly circumstanced co-accused Rakesh Gupta and Dina Gupta @ Dinanath Gupta have already been granted

Patna High Court Cr.Misc. No.29893 of 2018 (2) dt.18-05-2018 pre-arrest bail vide orders dated03.05.2018 passed in Cr. Misc. Nos.27052 of 2018 and 27103 of 2018 respectively. It is further contended that another co-accused whose case is identically situated to that of the petitioner namely Sunil Kumar has also been granted pre-arrest bail vide order dated 17.05.2018 passed in Cr. Misc. No.30559 of 2018.

The contention advanced on behalf of the petitioner has not been disputed by the learned counsel for the BSFC. In that view of the matter, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S. Case No. 55 of 2018 subject to the conditions as laid down under Section 438(2) Cr. P.C.
