The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 201 of the Indian Penal Code.

Petitioner in association of his family members is said to have tortured the daughter of the informant and lastly killed her on non-fulfillment of demand of dowry.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that deceased and her husband had been leading a happy conjugal life without any matrimonial discord, but the petitioner has been unnecessarily roped in the present

Patna High Court CR. MISC. No.28664 of 2020(4) dt.15-01-2021 2/2 case only with ulterior motive with concocted allegations. He further submits that petitioner bears no criminal antecedent as stated in para-3 of the bail petition and he is languishing in judicial custody since 11.12.2019.

Considering the fact that the petitioner is the husband of the deceased, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Dumariyaghat P.S. Case No. 149 of 2019 pending before the court of the learned Chief Judicial Magistrate, East Champaran.

Accordingly, the application is dismissed.
